Notarial and Civil Registry Law

Clear legal foundations before formalisation.

AGG Advogados prepares and assists with legal instruments, property transactions and registrations, aligning the legal content with the documents and formal requirements. The practice covers powers of attorney, wills and public deeds, as well as civil registration procedures, including marriage, birth registration and nationality.

Before signing, it is important to clarify the intended effects, the capacity in which each person acts and whether the document reflects the parties' wishes.

Legal preparation examines the content, legal capacity and authority to act, alongside the required form. Ambiguities or insufficient powers should be resolved before signing or submitting an application.

Who is acting, and with what authority.

Identity, capacity and documentation

The identity of the parties and the capacity in which they act shape preparation of the instrument. Signing on one's own behalf, representing another person and acting for a company are different situations. The documents should establish that position and allow the necessary capacity and authority to be verified.

AGG Advogados examines identification details, certificates and supporting documents relevant to the intended legal act. Inconsistent names, missing details or outdated information should be clarified before proceeding. The purpose is not to accumulate paperwork, but to understand what each item proves and what still needs to be established.

Powers of attorney suited to their purpose

A power of attorney grants authority to act on another person's behalf. Its usefulness depends on the acts it authorises, the limits imposed and the form required for the intended purpose. Broad authority does not always reflect the client's wishes, while wording that is too narrow may not cover the necessary act.

Support includes drafting and reviewing the wording, aligning the powers granted with their purpose and the authority before which they will be used. Where a power of attorney already exists, its content and the continuing validity of the powers must be assessed, without assuming that it covers every act or remains suitable after circumstances have changed.

The substance deserves as much attention as the form.

Property transactions and preparation of deeds

In a sale or gift, it is important to establish which right is being transferred, on what terms and subject to which charges or restrictions. Documents and registration information must be considered alongside the asset's circumstances and the parties' positions.

Creating a mortgage requires an assessment of the secured obligation, the assets covered and the extent of the security. In a division of property, each person's rights, the assets to be allocated and the consistency between the agreement and the instrument implementing it must be checked.

AGG Advogados assists with these transactions, checking title, charges and constraints, preparing the instrument and coordinating subsequent registration where applicable. Legal assessment clarifies what will be transferred, allocated or encumbered before commitments are made.

Assistance with a public deed begins before it is executed. The intended transaction, the terms agreed between the parties and the supporting documents must be considered together. A draft should be read for what it provides, not merely for the presence of formal elements.

Documentation is prepared and reviewed in coordination with the notary or competent authority. Terms still under discussion or differences from what was agreed should be resolved before formalisation. Assistance with a public deed does not mean that AGG Advogados acts as the notary executing it.

Wills and the expression of wishes

Preparing a will aligns the intended dispositions with the wording, legal requirements and form of the instrument. The text should express the testator's wishes precisely, respecting the personal nature of the act.

AGG Advogados assists with that legal preparation and with formalisation before the competent authority. Preparing and formalising a will is distinct from organising the succession as a whole, determining the heirs' positions and resolving any inheritance disputes.

Formalities that serve the legal purpose

AGG Advogados certifies signatures, authenticates private documents and certifies copies where appropriate to the transaction, procedure or regularisation concerned. The formality is assessed in light of the document's purpose, the authority of those acting and the applicable requirements.

Certifying a signature, authenticating a document and certifying a copy serve different functions. They form part of preparing the documents and carry professional responsibility, but do not replace assessment of the legal content.

Where there is an international element, AGG Advogados handles foreign documents, assists with obtaining apostilles or legalisation and coordinates with consulates as needed for their use. A document’s origin, destination and purpose must be considered together; an apostille does not validate its content. Support also covers acts that may lawfully be carried out remotely, checking identity, representation and formal requirements in each case, without assuming that physical attendance is always unnecessary.

Civil registration: the event, the evidence and the application.

Birth and marriage

Birth and marriage are events with legal effects that must be registered. Civil registration is not merely a document archive: the entries and the means of proving those events may be needed for other acts and procedures.

AGG Advogados assists with marriage procedures and civil registration relating to births, reviewing the available material, the identity of those concerned and the applicable requirements. For marriage, preparation of the procedure is distinct from the ceremony; for birth, the declared information must be considered alongside its supporting evidence.

Advice is particularly useful where documents differ, representation is uncertain or the registry requests clarification. The assessment focuses on the specific difficulty, without presenting every civil registration act as a complex procedure requiring a lawyer.

Nationality

Advice on nationality begins with the applicant's circumstances and the facts that may support an application. Collecting certificates does not replace assessment of the legal requirements, nor does a family relationship alone establish that an application is viable.

AGG Advogados prepares the application and supports the client throughout the process, coordinating the records, documents and information required by the competent authority. If further material is requested, the issue raised must be understood and a response prepared that is consistent with the existing application. Legal support cannot predict the decision or guarantee how long the process will take.

From the document to registration and proof

AGG Advogados prepares and assists with land, commercial and vehicle registrations in connection with transfers, changes to rights, corporate transactions and regularisation. The underlying instrument, registered information and intended change must be consistent; submitting a document does not mean that registration is complete.

The work includes coordinating the necessary material with the registry and checking the outcome of the application and the documents confirming it. This establishes what has been registered and whether any requirements remain outstanding, distinguishing the legal act, the filing and the subsequent registration.

Correcting discrepancies and responding to refusals

A discrepancy requires its origin to be identified: the document, the underlying instrument or the register. AGG Advogados handles rectification and regularisation, assessing the material supporting the correction and the rights involved. This is not simply a matter of replacing data: what the instrument can establish may need clarification.

Where registration is refused, the work begins with the stated grounds and the deadlines for responding. Reviewing the instrument, application and decision allows the appropriate remedy, correction or challenge to be prepared, coordinating the documentation with the competent authority. Disagreement alone does not ensure that the decision will be changed.
